These Terms and Conditions ("Terms") govern access to and participation in EWC Play, the gamification and fan engagement hub made available on www.esportsworldcup.com and related digital surfaces, including Fantasy, Pick'ems, Quests, Rewards and Leaderboards ("EWC Play"). EWC Play is designed as a unified digital experience that connects fans through predictions, fantasy games, quests, rewards, live participation, dynamic leaderboards, social engagement and multigame progression. EWC Play is intended to be available worldwide except where participation is prohibited or restricted by Applicable Law or by product-specific territorial restrictions disclosed in the Specific Rules. These Terms should be read together with any game-specific rules, prize information, FAQs, platform notices, privacy notices and other product guidance published on or through EWC Play, because the platform is intended to host multiple game formats, prize structures and content pages under a single hub. By registering for, accessing or participating in EWC Play, you ("Participant") agree to be bound by these Terms and the applicable specific rules for the relevant game, quest, leaderboard, campaign or promotion ("Specific Rules").
These Terms constitute a binding agreement between each Participant and the Esports Foundation, a non-profit organization registered with the National Center for Non-Profit Sector on 19/12/2023 in the Kingdom of Saudi Arabia under registration number 1100025300, having its office at 3450 Al Imam Saud Ibn Faisal Rd, 6496 Al Malqa District, 13523, Riyadh, Kingdom of Saudi Arabia (the "Organizer"). The Organizer offers EWC Play and is the contracting party for Participants under these Terms. Certain operational, technical, platform-management and prize-fulfilment aspects of EWC Play may be performed on the Organizer’s behalf by affiliates and service providers, including Dreamhack Sports Arabia (part of the ESL Faceit Group, or "EFG"), but the Organizer remains the contracting party under these Terms.
1. DEFINITIONS AND INTERPRETATION
1.1. Unless the context requires otherwise, in these Terms the following words and phrases shall have the following meaning:
1.1.1. "Applicable Law" means all statutes, regulations, orders, regulatory requirements, by-laws, ordinances, rules and other laws having legal effect and applicable to EWC Play, these Terms or the Participant's use of the Platform from time to time, including in the Kingdom of Saudi Arabia, the Participant’s jurisdiction of residence or access, and any other jurisdiction in which EWC Play or a relevant product is offered from time to time.
1.1.2. "Applicable Data Protection Laws" means all Applicable Law relating to the protection of personal data and the privacy of individuals, including: (a) the Personal Data Protection Law implemented by Royal Decree M/19 of 9/2/1443H (corresponding to 16 September 2021) as amended and all subordinate legislation made under it (the "PDPL"); (b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, "GDPR"); and (c) the French Act No. 78-17 of 6 January 1978 on Information Technology, Data Files and Civil Liberties (Loi Informatique et Libertés), as amended, together with all subordinate legislation, guidance and codes of practice issued under any of the foregoing, as updated or superseded from time to time.
1.1.3. "EWC Play" means the gamification and fan engagement hub made available on esportsworldcup.com and related digital surfaces, including Fantasy, Pick'ems, Quests, Rewards and Leaderboards, as further described in these Terms.
1.1.4. "Consumer" means any Participant who is a natural person acting for purposes which are wholly or mainly outside that person's trade, business, craft or profession and who is habitually resident in a Member State of the European Union or the European Economic Area.
1.1.5. "Force Majeure Event" means any act, event or circumstance beyond the Organizer's reasonable control, including acts of God, war, hostilities (whether or not war has been declared), armed conflict, military action, terrorist acts, acts of any civil or military authority, governmental or regulatory direction or restriction, riot, insurrection, civil commotion, pandemics, epidemics, fire, flood, earthquake, extreme weather conditions, cyberattack, power failure, telecommunications failure, shortage or unavailability of necessary supplies, equipment or personnel, sanctions, or any other event or circumstance that materially affects the Organizer's ability to operate EWC Play or any part thereof.
1.1.6. "Hijri" means the Islamic lunar calendar (also known as the Hijri calendar or the Umm al-Qura calendar), being the official calendar of the Kingdom of Saudi Arabia. References to age calculated in accordance with the Hijri calendar refer to age determined by reference to lunar years from the date of birth, as recognised under the laws of the Kingdom of Saudi Arabia. For the avoidance of doubt, a Hijri year is approximately 354 or 355 days, and accordingly a person attains a given age in Hijri years earlier than they would attain the same numerical age in Gregorian (solar) years.
1.1.7. "Intellectual Property Rights" means patents, rights to and in inventions, copyright, performers’ rights and related rights, image and persona rights, trade marks, business names and domain names, service marks, rights in get-up, goodwill and accrued rights to sue for passing off, rights in designs, database rights, rights in data, semiconductor topography rights, proprietary information rights, rights in know-how and confidential information and all other intellectual property and similar rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
1.1.8. "Organizer" or "EF" means the Esports Foundation, which provides and operates EWC Play and is the contracting party for Participants under these Terms.
1.1.9. "Participant" means any natural person who registers for, accesses or participates in EWC Play and who, by doing so, enters into a binding agreement with the Organizer on the basis of these Terms and the applicable Specific Rules. References to "you" and "your" in these Terms are references to the Participant.
1.1.10. "Platform" means the EWC Play website, pages, interfaces, tools, reward features, embedded surfaces and associated account functionality used to host Fantasy, Pick'ems, Quests, Leaderboards and related promotional features.
1.1.11. "Privacy Notice" means the privacy notice published by the Organizer on the Platform, as updated from time to time, which describes how the Organizer processes personal data in connection with EWC Play.
1.1.12. "Prize" means any cash prize, merchandise, digital item, experience, sponsor-funded reward, redemption opportunity or other benefit offered through EWC Play.
1.1.13. "Specific Rules" means the additional terms published for a particular game, title, quest, leaderboard, sponsor campaign, prize pool or other promotion, including the applicable scoring rules, lock times, prize descriptions and winner criteria. The applicable Specific Rules for each active game, quest, leaderboard or campaign will be published and accessible through the relevant product page on the Platform or through such other location as the Organizer may designate from time to time before participation in the relevant product, campaign or event window commences.
1.1.14. "Terms" means these terms and conditions, as amended from time to time in accordance with clause 25.
1.2. Unless the context requires otherwise, in these Terms:
1.2.1. the clause and paragraph headings are included for convenience only and shall not affect the interpretation of these Terms;
1.2.2. "writing" or "written" includes any method of reproducing words in a legible and non-transitory form, including email;
1.2.3. any words following the words "other", "includes", "including", "for example" and "in particular" are illustrative only and do not limit the generality of any preceding words where a wider construction is possible;
1.2.4. a reference to a statute or statutory provision includes all subordinate legislation made under that statute or statutory provision from time to time, and is a reference to it as amended, extended or re-enacted from time to time;
1.2.5.These Terms are published in English. If these Terms are translated into any other language, the English version shall prevail for all purposes to the extent permitted by Applicable Law.
2. ELIGIBILITY
2.1. Participation in EWC Play is open to Participants who meet the requirements of this clause 2 and who are at least seven (7) years of age. However, Participants under the age of eighteen (18) years (as determined in accordance with clause 2.2) have limited legal capacity and may participate only on the basis that participation is free of charge, purely beneficial to the Participant and on a participation-only basis. Participants under the age of eighteen (18) years are not eligible to win, claim or receive any Prize (whether cash or non-cash), and any ranking, points, XP or other in-product status obtained by such Participants does not create any entitlement to Prize payment, delivery, redemption or fulfilment. At the point of registration, Participants who indicate that they are under the age of eighteen (18) years shall be separately and prominently notified that they are not eligible to win, claim or receive any Prize, and must affirmatively acknowledge and confirm their understanding of this restriction before completing registration; failure to provide such acknowledgment shall prevent completion of the registration process. EParticipants aged eighteen (18) years and above have full legal capacity and may independently accept these Terms, participate in EWC Play and, subject to verification under clause 8, receive Prizes in their own name. The applicable Specific Rules may impose higher age requirements for particular games, quests, campaigns or Prizes where required by Applicable Law or the nature of the Prize.
2.2. Participants under the age of seven (7) years (calculated in accordance with the Hijri calendar for Participants resident in the Kingdom of Saudi Arabia and, for all other Participants, in accordance with the Gregorian calendar unless Applicable Law in the relevant jurisdiction requires another method of calculation) have no legal capacity and may not register for or participate in EWC Play. Participants aged between seven (7) and eighteen (18) years (calculated on the same basis) must have the permission of a parent or legal guardian to register for and participate in EWC Play, which shall be obtained by affirmation at the point of signup or participation and such permission must be provided during the signup flow before first participation. The Organizer may require evidence of such permission at any time.
2.3. The Organizer may reject, suspend or terminate any account or participation if it reasonably believes that a Participant does not meet the applicable age or capacity requirements, has not obtained the required parental or guardian consent, or has provided false age or eligibility information.
2.4. Each Participant must register and maintain an EWC Play user account in order to participate in any game or feature for which login is required.
2.5. Participation is void where prohibited. Subject to any product-specific restrictions set out in the applicable Specific Rules, EWC Play is open worldwide except where prohibited by local law. Subject to clause 2.7, each Participant bears sole responsibility for ensuring the lawfulness of their participation. The Organizer may designate particular products, features, campaigns, rewards or Prizes as territorially restricted in the applicable Specific Rules where this is necessary or desirable to address Applicable Law, sanctions, licensing obligations, technical limits, sponsor restrictions, onsite redemption mechanics or other compliance concerns. Without limitation, in certain jurisdictions only a limited version of EWC Play may be available, which may consist of Pick’ems only on a participation-only, no-reward basis, with no access to Fantasy, Quests, Rewards Hub redemption or any cash or non-cash Prize. Certain physical onsite Quests and related onsite reward redemption may be limited to the jurisdiction in which the EWC venue is located or to redemption at the EWC venue, as described in the applicable Specific Rules. The Organizer may impose hard geo-blocking, account blocks, payment blocks or other technical and operational controls where required to comply with sanctions, export controls, anti-money laundering requirements or other mandatory law. The Organizer may implement geo-blocking, IP-based restrictions, residence verification and other reasonable technical or operational controls to enforce territorial restrictions, and may update the list of territorially restricted products, features or prize mechanics in the Specific Rules where legal or operational requirements change.
2.6. Without limiting the generality of clause 2.5, certain jurisdictions are subject to full access restrictions (where all access to EWC Play is prohibited) or partial access restrictions (where only a limited, participation-only version of EWC Play is available, such as Pick'ems only with no cash or non-cash rewards, no reward-linked points, no sponsor rewards and no random tie-break mechanic). Participants located in or ordinarily resident in a restricted territory are subject to the corresponding access restrictions regardless of any technical means by which access may be obtained. Participants must not use virtual private networks, proxy servers, location-spoofing tools or any other means to circumvent, bypass or evade the territorial restrictions, geo-blocking measures or access controls implemented by the Organizer. Any participation obtained in breach of this clause is void, and the Organizer may suspend or terminate the relevant account, withhold or reclaim any Prize and take such other action as it considers appropriate under these Terms. The Organizer may update the territorial classifications set out in this clause from time to time, and any such update shall take effect on the date specified by the Organizer.
2.7. Each Participant acknowledges that the availability of EWC Play and the awarding of any Prize may be subject to local law and applicable regulations in the Participant's country or jurisdiction of residence. It is each Participant's sole responsibility to determine and ensure that their registration for, access to, participation in and receipt of any Prize through EWC Play is lawful under the laws of their jurisdiction of residence. The Organizer makes no representation or warranty that EWC Play or any Prize is lawful, available or appropriate in any particular jurisdiction. Where local law or regulations impose a cap or prohibition on the amount of winnings a Participant may receive, any such winnings shall be limited to the maximum amount legally permitted in that jurisdiction ("Prize Cap"), and any amount exceeding that Prize Cap shall be deemed forfeited and shall not be paid or otherwise awarded to the Participant. The Organizer reserves the right to withhold, adjust, reduce, cancel or refuse to deliver any Prize or portion thereof where it reasonably believes that payment or delivery would violate Applicable Law or applicable local regulatory requirements in the Participant's jurisdiction of residence.
3. REGISTRATION, ACCOUNTS, LOGIN AND PARTICIPATION REQUIREMENTS
3.1. To create an account, each Participant must complete the initial sign-up flow made available on the Platform using the Organizer’s approved EWC single sign-on account. Initial sign-up requires an email address only.
3.2. Each Participant must provide accurate, current and complete registration information and keep their account details up to date for the duration of their participation. Unless the Organizer expressly permits otherwise, each Participant may maintain only one personal account, must register in their own name, and must not create accounts on behalf of any other person, share login credentials, sell or transfer an account, or allow any other person to access or use the account.
3.3. Each Participant is responsible for all activity conducted through their account and for maintaining the security of their login credentials and devices. Each Participant must promptly notify the Organizer through the designated support channel if they suspect unauthorized access to their account, loss of credentials, account compromise or any other security incident affecting their participation.
3.4. After sign-up, the Organizer may require Participants to complete or update profile and eligibility information, including full name, date of birth, country of residence and any other fields designated by the Organizer from time to time. Such fields may initially be optional within the user profile, but may be made mandatory before a Participant can access or participate in EWC Play, claim a Prize or use particular features. Date of birth and country of residence must be provided before participation because they are used for age and territory eligibility checks. The Organizer may also confirm email addresses, identity or other eligibility information and may carry out reasonable verification checks before participation, before awarding a Prize or at any other time reasonably necessary to protect the integrity of the Platform. The Organizer may refuse registration, suspend, merge or disable duplicate, fictitious, misleading or unauthorized accounts, or require re-authentication, where it reasonably suspects unauthorized access, false information, abuse, circumvention of eligibility restrictions or breach of these Terms.
3.5. Where a Participant does not complete a required roster, predictions, quest step or other action by the relevant deadline, that Participant may receive no entry, no score, a reverted prior submission or such other outcome.
4. FREE-TO-PLAY NATURE OF THE PLATFORM
4.1. EWC Play is a free-to-play gamification environment. Participation is free of charge at all stages, including entry, registration, ongoing participation and winning. No Participant is required to make any payment, provide any monetary consideration, stake any funds, transfer any cryptoassets or commodities, or furnish any other form of consideration in order to sign up, access, participate in, play or win any Prize through EWC Play.
4.2. No purchase, payment, stake or consideration of any kind is required to enter or to win a Prize. The Organizer does not offer, and Participants are not required or permitted to purchase, any paid boosters, upgrades, power-ups, premium features or similar mechanisms intended to increase a Participant's chances of winning. Making a purchase, completing a commercial transaction, or interacting with a sponsor does not by itself increase a Participant's chance of winning unless the applicable Specific Rules expressly state otherwise and such mechanic is lawful in the relevant jurisdiction and does not require any payment by the Participant.
4.3. EWC Play is offered exclusively as a fan engagement and promotional platform and does not constitute, and is not intended to constitute, gambling, betting or any game of chance under Applicable Law. EWC Play shall not be used for betting or wagering purposes.
5. THE EWC PLAY OFFER AND HOW THE PLATFORM WORKS
5.1. EWC Play may include, among other things, Fantasy competitions, Pick'ems, Quests, product-specific and global Leaderboards, recommendation features, a rewards hub, XP and tier progression and social sharing functions.
5.2. After logging in, Participants may be directed to a homepage or hub view that displays a combination of their profile, display name, avatar, current tier badge, points balance, current rank, tier progression status, applicable points multiplier, faction status, recommendations and points history, and may then navigate to the available Fantasy, Pick'ems, Quests, Leaderboards, Rewards and other features made available for the relevant title, campaign, territory or event window. The homepage or hub view may also include a share-profile function that generates a branded summary card for publication or download through the channels designated on the Platform.
5.3. The availability, scope and timing of any particular game title, club, team, player, publisher mark or related feature may vary by title and jurisdiction and is subject to the Organizer securing and maintaining the necessary licences, consents, approvals and other rights from the relevant rights holders.
5.4. Fantasy enables Participants to build rosters of real players within a fictional budget and earn points based on actual player performance during EWC events. Fantasy may include title-specific leagues for supported EWC game titles, roster building by player role, live results, FAQs, team-selection deadlines, captain mechanics, auto-draft or auto-lock functions and title-specific leaderboards. The Platform may apply a fictional budget, role-based roster requirements and hard lock deadlines, and incomplete rosters may revert to the previously saved lineup or receive no entry for the relevant round, as specified on the Platform or in the Specific Rules. The Platform may also provide per-player scoring breakdowns, round results, searchable activity logs and global, weekly or all-time rank indicators.
5.5. Pick'ems enables Participants to predict match, stage and tournament outcomes across supported titles, with multiple formats, separate lock windows and title-specific scoring rules. Depending on the title and stage of competition, Pick'ems may include tournament-winner predictions, group or stage standings predictions, bracket predictions, match-winner prediction and other prediction formats designated by the Organizer. Pick’ems may be displayed in chronological order and may include views for live, upcoming, past or all predictions windows, together with community prediction metrics, points earned and rank information. Participants must submit their predictions before the relevant lock time in order to score points for that event window, and live or final result displays may update as matches are resolved.
5.6. Quests convert online and onsite activities, including QR scans, trivia, social engagement, sponsor activations and other actions, into points, XP and leaderboard progression. Quests may be daily, weekly, standard, prerequisite or sponsored and may include, for example, single-scan QR quests, sequential or non-sequential multi-scan venue or city quests, trivia quests, profile-completion tasks, sponsor interactions, social sharing actions, tag-based actions, follow-and-repost actions, livestream or event engagement actions and other online or onsite participation mechanics. Quest views may include status filters, progress bars, completion states and expiry dates. Trivia quests may award points based on answer accuracy, countdown windows or other published scoring rules. Social-sharing quests are available only on the social platforms designated on the Platform for the relevant quest, which may include TikTok, X, Instagram or successor or substitute services. The applicable Specific Rules may limit certain Quests, including Quest products linked to physical rewards redeemable onsite at the EWC venue, to France or to such other designated territory or venue as disclosed for the relevant Quest. Subject to clause 2.5 and the applicable Specific Rules, Quests are generally available globally. Only physical onsite Quests and related onsite reward redemption mechanics are territorially restricted and those mechanics are limited to redemption at the EWC venue in France.
5.7. The Organizer may offer one or more leaderboards, including global, weekly, game-specific, faction-based, sponsored, creator-linked or other special leaderboards, and may award prizes by reference to one or more of those leaderboards as described in any applicable Specific Rules. Leaderboards may show overall rank, product-specific rank, weekly performance, global performance, title-specific performance, faction rankings, creator-linked rankings, sponsor-linked rankings or per-product point breakdowns, depending on the configuration chosen by the Organizer. The Platform may feature highlighted leaderboards such as overall and current-week views, full ranked tables and faction-specific views. Faction-based features may require a Participant to join a faction for a specified event window or week, after which eligible in-product activity may contribute to that faction’s score. The number of rewarded positions for any leaderboard will be stated in the applicable Specific Rules or prize information.
6. POINTS, XP, SCORING, LOCKOUTS, LEADERBOARDS AND PLATFORM RECORDS
6.1. Each game format, quest or promotion may have its own scoring rules, lockout times, deadlines, point pools, leaderboards and ranking methodology, all of which may vary by title, stage, campaign or event window. Participants may earn points, XP or both through eligible activity on the Platform, including, accurate predictions, fantasy performance, quest completion and any other scoring actions clearly described in the applicable Specific Rules for the relevant product or campaign. Depending on the final platform design, points or XP may affect title-specific rankings, overall rankings, tier progression, reward eligibility, point multipliers or prize qualification. The Platform may use tier structures, multipliers, boosts or similar status mechanics, including named tiers shown on the Platform from time to time, and the names, thresholds and effects of those mechanics will be shown on the Platform or in the Specific Rules.
6.2. Rosters, predictions, scans, trivia answers, quest completions and other actions must be completed before the applicable lockout or expiry time shown on the Platform, and late submissions may be rejected automatically. The Organizer may publish or display scoring tables, XP tables, booster rules, point multipliers, rank thresholds, level thresholds, reward thresholds or similar participation mechanics on the Platform, in the Specific Rules or in other official game guidance. Where relevant, the Platform may display a Participant’s current tier, XP earned, XP needed for the next tier, applicable boost or multiplier, points history and other explanatory information regarding scoring or rewards.
6.3. The Organizer may use points histories, audit logs, activity logs, data-feed records and other backend records to determine whether a Participant validly entered, completed a quest, achieved a score, ranked on a leaderboard or qualified for a Prize. Except in the event of manifest error, the Organizer’s records and calculations in relation to scores, XP, rankings, lockouts, quest completions and prize eligibility are final and binding. The Platform may make available transaction histories, results tables, roster logs, activity feeds or similar records for transparency and dispute resolution purposes.
7. PRIZE STRUCTURE, REWARDS AND HOW WINNERS ARE DETERMINED
7.1. The total cash prize pool for EWC Play is USD 300,000. Subject to the applicable Specific Rules, this cash pool is allocated across a General Leaderboard pool, escalating weekly pools for Weeks 1 to 7, and a dedicated pool for each core offer. The applicable prize pool, ranking positions, reward types and any per-title or per-campaign allocations will be published in the Specific Rules, the prize information page or other official Platform notices for the relevant game, leaderboard or campaign. Each game, leaderboard, quest or campaign may have its own prize structure and its own number of rewarded positions. Participants may become eligible for rewards or prizes by completing qualifying activity, reaching designated rank positions, satisfying quest conditions, earning sufficient points or XP, redeeming eligible points in the Rewards Hub, entering published prize-entry mechanics, or otherwise meeting the criteria published for the relevant game, leaderboard, quest or campaign.
7.2. Prizes may include cash amounts, digital rewards, merchandise, hardware, experiences, sponsor-provided items, sponsor-funded prize opportunities, physical Quest rewards or other benefits designated by the Organizer. Some rewards may be granted instantly or made available for in-product redemption, while other prizes may be awarded only after the relevant event window, leaderboard period or campaign closes and the Organizer has completed ranking and verification. In-kind prizes, including hardware or other merchandise, may be confirmed, updated or supplemented from time to time and will be identified together with the relevant reward type in the Specific Rules, the prize information page or other official Platform notices for the relevant game, leaderboard or campaign. The Organizer will disclose the prizes available for each game, leaderboard, quest or campaign before participation in the relevant product or event window.
7.3. Cash Prizes shall be funded and distributed by the Organizer and/or its designated affiliates, including EFG, acting on the Organizer’s behalf, and shall be delivered through the Organizer's designated payment provider, Payment Pro Logistics LLC (trading as "Payment Labs"), to an account or payment destination nominated by the Participant via the Payment Labs portal, using one of the payment methods set out in clause 7.4 and as further specified in the applicable Specific Rules. Monetary Prizes will not be credited to any in-platform stored-value account unless the applicable Specific Rules expressly provide for that mechanic and the Organizer determines that it is lawful and operationally available in the relevant jurisdiction. The Organizer shall ensure that the method of delivery of monetary Prizes complies with all Applicable Law, including applicable payment services regulations, anti-money laundering requirements and any licensing or permit conditions. Where delivery of a monetary Prize requires the Participant to provide bank account details, payment credentials or other financial information, the Organizer shall process such information in accordance with Applicable Data Protection Laws and the Privacy Notice, and the Participant shall provide accurate and complete information to facilitate delivery.
7.4. Subject to availability in the Participant's jurisdiction and the applicable Specific Rules, the following payment methods may be made available through the Payment Labs portal for the delivery of cash Prizes: (a) instant transfer (debit card); (b) PayPal; (c) ACH transfer; (d) international wire transfer (SWIFT, without foreign exchange conversion); (e) international wire transfer (SWIFT, with foreign exchange conversion); and (f) local bank transfer (international). Not all payment methods are available in all jurisdictions; the payment methods available to a Participant will be determined by the Participant's country of residence and the applicable regulatory and operational requirements. The Organizer shall use reasonable efforts to deliver each cash Prize within thirty (30) days of the date on which the Participant has submitted all required information (including bank account details, payment credentials and any verification documentation) to the Payment Labs portal in complete and accurate form, provided that the actual delivery timeline may vary depending on the Participant's location, the selected payment method, third-party processing times and compliance checks required by Applicable Law. The Organizer shall not be liable for any delay in Prize delivery attributable to incomplete or inaccurate information provided by the Participant, third-party payment processing times or circumstances beyond the Organizer's reasonable control.
7.5. Different game types and leaderboards may carry separate prize pools and different numbers of rewarded positions, and the Organizer may allocate prizes independently by product, title, leaderboard, campaign or reward category, including across the General Leaderboard pool, the weekly pools and the dedicated pools for core Fantasy titles.
7.6. Unless the Specific Rules state otherwise, winners will be determined by the final verified leaderboard, final verified score or other final verified competition outcome for the relevant event window, after application of the applicable tie-break rules and eligibility checks. All prize values are stated in the applicable currency or equivalent value published by the Organizer, are non-transferable unless the Organizer expressly permits transfer, and may not be exchanged by the winner for a different prize except at the Organizer’s discretion.
7.7. The Organizer may substitute a Prize with a prize of equal or greater value where reasonably necessary because of availability, sponsor changes, shipping restrictions, sanctions, legal requirements or other circumstances outside the Organizer’s reasonable control.
7.8. The Organizer may withhold, reduce, cancel, reclaim or refuse to deliver any Prize where the participant is ineligible, cannot be verified, has breached these Terms, may be subject to sanctions, has engaged in fraud or abuse, or where withholding or cancellation is required by Applicable Law or reasonably necessary to protect the integrity of the promotion.
7.9. The tax treatment of Prizes is governed by clause 10.
8. WINNER VERIFICATION
8.1. Potential winners and Participants seeking Prize payment, delivery or redemption may be required to complete identity, age, residency, sanctions, anti-fraud, account ownership and eligibility checks, and to provide supporting documents within the period specified by the Organizer. Without limitation, any Participant selected for a Prize must verify that they are at least eighteen (18) years old at the time of Prize payment, delivery or fulfilment; if that verification is not completed or is not satisfied, the Participant is ineligible and the Prize may be withheld, cancelled or reallocated in accordance with the Specific Rules.
8.2. The Organizer may require an affidavit, declaration, tax form, release, bank details, shipping details or other reasonable documentation before confirming a Prize.
8.3. If a potential winner does not respond, cannot be contacted, does not complete verification in time, fails any verification requirement, or is otherwise found ineligible, the Organizer may disqualify that participant and select an alternate winner or take such other action as provided in the Specific Rules.
9. TIE-BREAKS
9.1. Where two or more Participants have the same score, XP total or ranking result after application of any preliminary tie-break criteria published in the Specific Rules, the tie shall be resolved by random draw conducted by or on behalf of the Organizer, provided that such method is lawful in the relevant jurisdiction. If a random draw is not lawful, not technically feasible or not operationally appropriate in the relevant jurisdiction, the Organizer may instead apply a further objective tie-break criterion (such as earlier qualifying submission timestamp), split the affected Prize equally among the tied Participants where permitted, substitute a non-cash reward of equivalent value, or declare the tied Participants joint winners, in each case to the extent allowed by Applicable Law and the applicable Specific Rules.
9.2. The random draw shall be conducted using a verifiable randomisation method selected by the Organizer. The Organizer shall record the outcome of any random draw and make the result available to affected Participants upon reasonable request. The applicable Specific Rules may specify additional procedural requirements for the conduct of the random draw.
10. TAXES
Unless the applicable Specific Rules expressly state otherwise, each Participant is solely responsible for determining and paying any taxes, duties, levies, charges or other fiscal obligations arising in connection with the receipt, use or enjoyment of any Prize, including income tax, value added tax, customs duties and any reporting obligations in the Participant's jurisdiction of residence. The Organizer makes no representation regarding the tax treatment of any Prize and does not provide tax advice. Where the Organizer is required by Applicable Law to withhold or deduct any amount from a Prize for tax purposes, the Organizer may do so and the net amount delivered to the Participant shall be deemed full satisfaction of the Organizer's obligation to award that Prize.
11. SPONSOR-RELATED QUESTS, THIRD-PARTY PROMOTIONS AND RIGHTS HOLDER CONTENT
11.1. EWC Play may include sponsored quests, sponsor-themed trivia, sponsor branding, sponsor landing pages, sponsor rewards collections, sponsor leaderboards, sponsor merchandise redemption options and sponsor-funded prize opportunities. Sponsor-related quest pages may be co-branded and may include one or more quest formats, sponsor rewards collections or sponsor-funded prize-entry mechanics. EWC Play may also feature game titles, publisher marks, club marks, team marks, player names, likenesses, logos and other third-party content where the Organizer considers such use to be authorized or otherwise permitted. The Organizer may limit, delay, withdraw, replace or geo-restrict any such content, game title or related feature if the relevant rights, approvals or contractual clearances are unavailable, pending, challenged, withdrawn or subject to conditions. A sponsor-related quest may require a Participant to interact with sponsor content, visit a sponsor page, scan a sponsor QR code, answer sponsor-themed trivia, redeem sponsor-branded rewards, follow or repost content, or complete other sponsor campaign actions described on the Platform.
11.2. Some sponsor integrations, advertisements or activations may be geo-restricted or unavailable in certain territories, and the Organizer may disable, vary or replace sponsor content on a territory-by-territory basis. Sponsor-provided prizes are offered subject to availability and any additional lawful conditions disclosed in the Specific Rules, and the Organizer is not responsible for a sponsor’s independent acts, omissions, website terms or privacy practices except to the extent required by law.
11.3. Where participation in a sponsor-related quest involves processing or disclosure of personal data to or from a sponsor, the Organizer will address that processing through the applicable Privacy Notice, consent mechanism or campaign-specific notice as required by the Applicable Data Protection Laws.
12. SOCIAL FEATURES, PUBLIC DISPLAY AND USER CONTENT
12.1. The Platform may display a Participant's username, display name, avatar, profile details, leaderboard rank, score, points balance, XP totals, tier status, league status, faction participation or other limited account information in connection with that Participant's participation in EWC Play, in accordance with the Privacy Notice and subject to the Participant’s applicable privacy settings and choices made available on the Platform.
12.2. If you participate in public leagues, social sharing features, faction competitions or share-profile functions, content associated with your participation may be visible to other users or to the public. The Platform may permit Participants to generate and share branded profile cards or other share assets through the channels designated on the Platform, and may also make certain leaderboard content visible on public or display surfaces, in each case as described in the Privacy Notice and subject to any required consents under Applicable Data Protection Laws. By using such features, you grant the Organizer a non-exclusive, worldwide, royalty-free licence during the term of your participation to host, reproduce, display, distribute and communicate your submitted or account-linked content solely for operating, promoting and administering EWC Play and associated prize promotions. You must not upload, submit, share or otherwise use content that is unlawful, infringing, abusive, discriminatory, threatening, obscene, deceptive or otherwise inappropriate. The Organizer may remove or disable access to content that it reasonably suspects is inappropriate or non-compliant.
13. PARTICIPANT CONDUCT, PROHIBITED CONDUCT AND INTEGRITY RULES
13.1. Participants must comply with these Terms, the applicable Specific Rules, all reasonable platform instructions issued by the Organizer and all Applicable Law when accessing or using EWC Play.
13.2. Participants must act fairly and respectfully towards other Participants, the Organizer, sponsors, moderators, support personnel and rights holders, and must not harass, threaten, abuse or otherwise interfere with any person in connection with EWC Play.
13.3. Participants must not upload malware, spam, unlawful promotional content or any material that disrupts the Platform, and must not misuse customer support, reporting tools, social features or any community or moderation function made available through EWC Play.
13.4. No Participant shall cheat, collude, use bots, scripts, automation, false accounts, scraping tools, reverse engineering, security circumvention, data extraction, or any other manipulative practice designed to gain an unfair advantage or undermine the integrity of the Platform.
13.5. No Participant shall exploit bugs, attempt unauthorized access, interfere with scoring or rankings, falsify location or eligibility data, or misrepresent identity, age or residency. No Participant shall use EWC Play for betting purposes or in any manner that would cause the Organizer or its service providers to breach Applicable Law, licensing obligations or platform rules.
14. PARTICIPANT REPRESENTATIONS
Each Participant represents, warrants and undertakes to the Organizer that:
14.1. they meet the applicable age and legal capacity requirements set out in clause 2 and, where they are under the age of eighteen (18) years as determined under clause 2, they have obtained the consent of a parent or legal guardian as required by these Terms and Applicable Law;
14.2. all information provided by them in connection with their registration and participation is true, accurate, current and complete;
14.3. their use of EWC Play will comply with all Applicable Law and will not infringe the rights of any third party;
14.4. they are located in or ordinarily resident in a jurisdiction from which participation in the relevant product is not prohibited under these Terms or the applicable Specific Rules, have complied with any product-specific territorial restriction disclosed for the relevant game, quest, leaderboard, campaign or Prize, and are not subject to any sanctions that would prohibit their participation; and
14.5. they shall not make any derogatory statement or otherwise act in any manner that, in the reasonable opinion of the Organizer, brings or is likely to bring the Organizer, EWC Play, the Esports World Cup, or the Kingdom of Saudi Arabia (including the Crown Prince or any governmental official) into disrepute or will cause or is likely to cause damage to the reputation or business of EF, or the Kingdom of Saudi Arabia (including the Crown Prince or any governmental official).
15. INTELLECTUAL PROPERTY
15.1. All Intellectual Property Rights in and to EWC Play, the Platform, and all content, software, designs, text, graphics, logos, icons, images, audio, video, data compilations, scoring algorithms, game mechanics and other materials made available through EWC Play are and shall remain the exclusive property of the Organizer or its licensors. Nothing in these Terms transfers or assigns any Intellectual Property Rights to any Participant.
15.2. Subject to the Participant's compliance with these Terms, the Organizer grants each Participant a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use EWC Play for personal, non-commercial purposes only. This licence does not include the right to: (a) copy, modify, distribute, sell, lease or create derivative works of any part of EWC Play; (b) reverse engineer, decompile or disassemble any software or technology underlying the Platform; (c) use any data mining, robots, scraping or similar data-gathering tools on the Platform; or (d) use EWC Play or any content therein for any commercial purpose without the Organizer's prior written consent.
15.3. No Participant shall use, reproduce or display any trade marks, logos, branding or other Intellectual Property Rights of the Organizer or its licensors except as automatically displayed through normal use of the Platform, unless the Organizer has given prior written consent.
16. DATA PROTECTION AND PRIVACY
16.1. The Organizer processes personal data in connection with EWC Play in accordance with Applicable Data Protection Laws and the Privacy Notice. By registering for or using EWC Play, each Participant acknowledges that they have read and understood the Privacy Notice. as determined under clause 2,The parental or guardian permission referred to in clause 2.2 for Participants aged seven (7) to seventeen (17) is obtained by affirmation at signup for participation purposes. Separately, where Applicable Data Protection Laws require parental or guardian consent, authorisation or verification for the processing of a minor Participant's personal data, the Organizer shall implement the relevant consent or verification measure before carrying out the relevant processing. In respect of Participants resident in the French Republic, the Organizer shall obtain the consent of the holder of parental responsibility for the processing of personal data of any Participant under the age of fifteen (15) years in connection with information society services, in accordance with Article 8 of the GDPR as implemented by Article 45 of the Loi Informatique et Libertés. The Organizer implements appropriate safeguards for the processing of sensitive personal data, including bank account details and financial information collected for the purpose of Prize delivery, and processes such data only to the extent necessary for the specified purpose and in accordance with Applicable Data Protection Laws.
16.2. The Organizer may collect, use, store and otherwise process personal data provided by or generated through a Participant's use of EWC Play for the purposes described in the Privacy Notice, including account administration, identity and eligibility verification, prize fulfilment, fraud prevention, platform improvement, analytics, personalisation and compliance with Applicable Law.
16.3. Each Participant may exercise their rights under Applicable Data Protection Laws, including rights of access, rectification, erasure, restriction, portability and objection, by contacting the Organizer through the channels specified in the Privacy Notice. The Organizer will respond to valid requests within the timeframes required by Applicable Data Protection Laws.
17. PLATFORM SECURITY
The Organizer implements reasonable technical and organisational measures to protect the Platform and Participant data against unauthorised access, loss, misuse or alteration. However, no system is completely secure, and while the Organizer cannot guarantee absolute security of the Platform or any data transmitted to or from EWC Play, it continues to maintain appropriate technical and organisational measures to protect the Platform and personal data subject to Applicable Data Protection Laws. Each Participant is responsible for maintaining the security of their own devices, networks and login credentials used to access EWC Play.
18. CHANGES TO THE PLATFORM AND SERVICES
18.1. The Organizer may at any time, without prior notice and without liability to any Participant, modify, update, suspend, discontinue or remove any feature, game, quest, leaderboard, reward, content or other aspect of EWC Play, whether temporarily or permanently, where reasonably required for maintenance, security, legal compliance, operational or commercial reasons, provided that such modifications are not implemented in a manner that materially affects a Participant’s existing rights under the Terms.
18.2. Where a modification to the Platform or any feature of EWC Play materially affects a Participant's existing rights under these Terms, the Organizer will use reasonable efforts to provide advance notice through the Platform, by email or by other appropriate means. For amendments to these Terms, clause 25 shall apply.
19. SUSPENSION AND TERMINATION
The Organizer may, at any time and without prior notice, suspend, restrict or terminate a Participant's access to EWC Play or any part thereof, or close a Participant's account, where the Organizer reasonably believes that:
19.1. the Participant has breached these Terms or any applicable Specific Rules;
19.2. the Participant has engaged in fraud, abuse, manipulation or other misconduct;
19.3. the Participant is or has become ineligible to participate;
19.4. suspension or termination is required or advisable to comply with Applicable Law, a court order, regulatory direction or third-party rights; or
19.5. continued access by the Participant poses a risk to the security, integrity or operation of the Platform or to other Participants.
20. PARTICIPANT'S RIGHT TO TERMINATE
A Participant may terminate these Terms and close their account at any time by using the account deletion function on the Platform or by contacting the Organizer through the designated support channel. Upon termination:
20.1. the Participant's access to EWC Play and all associated features will be deactivated;
20.2. any accumulated points, XP, tier status, leaderboard positions and unredeemed rewards associated with the Participant's account will be forfeited and cannot be recovered;
20.3. any Prize that has been confirmed and Fehler! Verweisquelle konnte nicht gefunden werden.; and
20.4. all provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including the liability, intellectual property, indemnification, dispute resolution and general provisions.
21. LIABILITY
21.1. To the maximum extent permitted by Applicable Law, EWC Play and all content, features, games, quests, leaderboards, rewards and other services made available through the Platform are provided on an "as is" and "as available" basis without warranty or representation of any kind, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, reliability, availability, uninterrupted access or non-infringement. The Organizer does not warrant that the Platform will be error-free, uninterrupted, secure or free from viruses or other harmful components, that defects will be corrected, or that any particular result, score, ranking, Prize or reward will be achieved or awarded.
21.2. To the maximum extent permitted by Applicable Law, the Organizer shall not be liable to any Participant or any other person for any direct, indirect, incidental, special, consequential, exemplary or punitive damages of any kind, including loss of profits, loss of revenue, loss of data, loss of goodwill, loss of opportunity, loss of anticipated savings, business interruption, reputational damage, cost of substitute services or any other tangible or intangible losses, arising out of or in connection with these Terms, EWC Play, the Platform, any Prize or any Participant's access to, use of, inability to use or reliance on EWC Play, whether based on contract, tort (including negligence), strict liability, statute or any other legal theory, and regardless of whether the Organizer has been advised of the possibility of such damages or whether such damages were foreseeable.
21.3. To the maximum extent permitted by Applicable Law, the Organizer's total aggregate liability to any Participant for all claims arising out of or in connection with these Terms, EWC Play, the Platform or any Prize, whether in contract, tort (including negligence), strict liability, statute or otherwise, shall not exceed SAR 500 (five hundred Saudi Riyals) (or the equivalent in the local currency of the Participant's country of habitual residence at the prevailing exchange rate on the date the claim arises). This limitation shall not apply to the matters set out in clause 21.5.
21.4. Each Participant shall indemnify, defend and hold harmless the Organizer and its affiliates, officers, directors, employees, agents, licensors, sponsors and service providers from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) that Participant's breach of these Terms or any applicable Specific Rules; (b) that Participant's violation of Applicable Law or the rights of any third party; (c) that Participant's use of or conduct on the Platform; or (d) any content submitted, posted or transmitted by that Participant through EWC Play.
21.5. Nothing in these Terms shall exclude or limit the Organizer's liability to the extent that such exclusion or limitation is prohibited by Applicable Law, including liability for: (a) death or personal injury caused by the Organizer's gross negligence or wilful misconduct; (b) fraud or fraudulent misrepresentation by the Organizer; or (c) any other matter for which liability cannot lawfully be excluded or limited under the Applicable Law of the relevant jurisdiction. Where any jurisdiction does not allow the exclusion or limitation of certain warranties or liabilities, the limitations and exclusions set out in this clause shall apply to the fullest extent permitted by the law of that jurisdiction, and any liability not capable of exclusion shall be limited to the minimum extent required by such law. The provisions of clause 28.2 apply in addition to this clause in respect of Consumers.
22. FORCE MAJEURE
22.1. A "Force Majeure Event" has the meaning given to it in clause 1.1.5.
22.2. To the extent that the Organizer is prevented, hindered or delayed from operating EWC Play or any game, quest, leaderboard, campaign or promotion by reason of a Force Majeure Event, the Organizer shall not be liable to any Participant for any failure or delay in performing its obligations under these Terms for the duration of the Force Majeure Event. The Organizer may, in its sole discretion, suspend, postpone, modify, shorten or cancel any affected game, quest, leaderboard, campaign, promotion, Prize or other feature of EWC Play without liability to Participants.
22.3. Where a Force Majeure Event affects a game, quest, leaderboard or campaign that is in progress, the Organizer may, at its sole discretion: (a) extend the relevant deadlines or event windows; (b) determine final standings on the basis of results available at the time of suspension or cancellation; (c) award Prizes on a pro-rata or adjusted basis; (d) substitute affected Prizes with alternatives of equal or greater value; or (e) void the affected game, quest, leaderboard or campaign in whole or in part without awarding Prizes. The Organizer will use reasonable efforts to notify Participants of any material changes through the Platform.
23. COMPLIANCE
Each Participant shall use EWC Play in compliance with all Applicable Law, including anti-money laundering laws, sanctions regulations and anti-corruption laws. No Participant shall use EWC Play or any Prize for the purpose of money laundering, terrorist financing, sanctions evasion or any other unlawful activity. The Organizer reserves the right to report suspicious activity to the relevant authorities and to suspend or terminate any account where it reasonably suspects non-compliance with this clause.
24. ASSIGNMENT AND TRANSFER
24.1. No Participant may assign, transfer, sublicense or delegate any of their rights or obligations under these Terms, or transfer their account, to any third party without the Organizer's prior written consent. Any purported assignment or transfer in violation of this clause is null and void.
24.2. The Organizer may freely assign, transfer or delegate any of its rights or obligations under these Terms to any affiliate, successor or third party without the Participant's consent, provided that such assignment does not materially reduce the Participant's rights under these Terms.
25. AMENDMENTS TO THESE TERMS
25.1. Subject to clause 28.5, the Organizer reserves the right to amend, update or replace these Terms at any time. Where the Organizer makes a material change, it will use reasonable efforts to notify Participants in advance by posting the revised Terms on the Platform, by email or by other appropriate means, together with the date on which the revised Terms take effect.
25.2. A Participant's continued use of EWC Play after the effective date of any amendment constitutes acceptance of the amended Terms. If a Participant does not agree to the amended Terms, that Participant must discontinue use of EWC Play and close their account before the effective date. The most current version of these Terms will always be available on the Platform.
26. GOVERNING LAW AND DISPUTE RESOLUTION
26.1. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. However, if the Participant is habitually resident in the French Republic, this choice of law shall not deprive the Participant of the protection afforded by provisions that cannot be derogated from by agreement under French law pursuant to Article 6(2) of Regulation (EC) No 593/2008 (Rome I). If the Participant is a consumer habitually resident in the European Union or the European Economic Area, this choice of law shall not deprive the Participant of the protection afforded by provisions that cannot be derogated from by agreement under the law of the Participant's country of habitual residence pursuant to Article 6(2) of Regulation (EC) No 593/2008 (Rome I).
26.2. In the event of any dispute arising out of or in connection with these Terms, the Participant shall first contact the Organizer through the designated support channel and the parties shall attempt to resolve the dispute amicably. If the dispute cannot be resolved within thirty (30) days, either party may submit the dispute to the exclusive jurisdiction of the competent courts of Riyadh, Kingdom of Saudi Arabia. Notwithstanding the foregoing, if the Participant is habitually resident in the French Republic, the Participant may bring proceedings in the competent courts of France in accordance with Article 18 of Regulation (EU) No 1215/2012 (Brussels Ia), and the Organizer may bring proceedings against such Participant only in the courts of the Member State in which the Participant is domiciled. If the Participant is a consumer habitually resident in the European Union or the European Economic Area, the Participant may bring proceedings in the courts of the Member State in which the Participant is domiciled in accordance with Article 18 of Regulation (EU) No 1215/2012 (Brussels Ia), and the Organizer may bring proceedings against such Participant only in the courts of the Member State in which the Participant is domiciled.
27. GENERAL PROVISIONS
27.1. If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
27.2. These Terms, together with the applicable Specific Rules, the Privacy Notice and any other documents expressly incorporated by reference, constitute the entire agreement between the Organizer and each Participant in relation to EWC Play and supersede all prior or contemporaneous communications, representations or agreements, whether oral or written, relating to the subject matter hereof.
27.3. No failure or delay by the Organizer in exercising any right, power or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude any further exercise of that right or the exercise of any other right.
27.4. Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, employment or fiduciary relationship between the Organizer and any Participant.
27.5. These Terms do not confer any rights on any person other than the Participant and the Organizer, except that the Organizer's affiliates, licensors, sponsors and service providers may enforce any provision of these Terms that expressly or by necessary implication confers a benefit on them.
27.6. Any questions, complaints or notices relating to these Terms or EWC Play should be directed to the Organizer at ewcplay@esportsfoundation.com or through the other support or contact channels published on the Platform. The Organizer may send notices to Participants by email to the address associated with their account, by in-platform notification or by posting on the Platform, and such notices shall be deemed received at the time of sending or posting.
28. ADDITIONAL PROVISIONS FOR PARTICIPANTS HABITUALLY RESIDENT IN THE EUROPEAN UNION OR THE EUROPEAN ECONOMIC AREA
28.1. The provisions of this clause apply to any Consumer. In the event of any conflict between the provisions of this clause and any other provision of these Terms, the provisions of this clause shall prevail to the extent necessary to ensure compliance with the mandatory consumer protection laws of the Consumer's country of habitual residence.
28.2. Notwithstanding clause 21, the following shall apply to Consumers: (a) nothing in these Terms shall exclude or limit the Organizer's liability for damages resulting from injury to life, body or health caused by a negligent or intentional breach of duty by the Organizer, its legal representatives or its vicarious agents; (b) nothing in these Terms shall exclude or limit the Organizer's liability for damages caused by intentional or grossly negligent breaches of duty by the Organizer, its legal representatives or its vicarious agents; (c) the Organizer's liability for breach of material contractual obligations (i.e. obligations the fulfilment of which is essential for the proper performance of these Terms and on the compliance with which the Consumer regularly relies and may rely) caused by simple negligence shall be limited to the foreseeable, typically occurring damage; and (d) the disclaimer of warranties in clause 21.1 shall not affect any mandatory conformity requirements or remedies to which the Consumer is entitled under Directive (EU) 2019/770 (Digital Content Directive) as implemented in the Consumer's country of habitual residence, including the right to have the digital content or digital service brought into conformity, to receive a proportionate reduction or to terminate the contract in the event of a lack of conformity.
28.3. Clause 21.4 (indemnification) shall not apply to Consumers. Nothing in these Terms shall impose on a Consumer any obligation to indemnify the Organizer beyond the Consumer's statutory liability for damages under the applicable law of the Consumer's country of habitual residence.
28.4. Notwithstanding clause 19, before suspending or terminating a Consumer's account (other than in cases of serious or repeated breach, fraud, or where immediate action is required to comply with Applicable Law or to protect the security of the Platform or other Participants), the Organizer shall: (a) provide the Consumer with a statement of reasons for the intended suspension or termination; (b) give the Consumer a reasonable opportunity (not less than fourteen (14) days) to remedy the breach or respond to the statement of reasons; and (c) notify the Consumer of the effective date of the suspension or termination and of the Consumer's right to seek redress. Where a Consumer's account is terminated, any confirmed and verified Prize entitlement that has accrued prior to termination shall not be forfeited solely by reason of the termination.
28.5. Notwithstanding clause 25, where the Organizer proposes a material amendment to these Terms that adversely affects the rights or obligations of a Consumer, the Organizer shall: (a) notify the Consumer of the proposed amendment in a clear and comprehensible manner at least thirty (30) days before the amendment takes effect; (b) inform the Consumer of the nature and reasons for the amendment; and (c) inform the Consumer of the Consumer's right to terminate these Terms free of charge before the amendment takes effect. If the Consumer does not terminate before the effective date, the Consumer shall be deemed to have accepted the amendment. The Consumer's right to terminate under this provision is without prejudice to any other termination rights under these Terms or Applicable Law.
28.6. A Consumer who enters into these Terms at a distance (within the meaning of Directive 2011/83/EU as implemented in the Consumer's country of habitual residence) has the right to withdraw from these Terms within fourteen (14) days without giving any reason. The withdrawal period shall expire fourteen (14) days after the day of the conclusion of the contract (i.e. the date of registration). To exercise the right of withdrawal, the Consumer must inform the Organizer (Esports World Cup Foundation, 3450 Al Imam Saud Ibn Faisal Rd, 6496 Al Malqa District, 13523, Riyadh, Kingdom of Saudi Arabia; email: ewcplay@esportsfoundation.com) of the decision to withdraw by an unequivocal statement (e.g. a letter sent by post or email). The Consumer may use the model withdrawal form set out below but is not obliged to do so. To meet the withdrawal deadline, it is sufficient for the Consumer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. If the Consumer withdraws from these Terms, the Organizer shall not charge the Consumer any costs, given that EWC Play is provided free of charge. The Consumer acknowledges that, because EWC Play is a digital service supplied on a continuous basis within the meaning of Article 16(m) of Directive 2011/83/EU, the right of withdrawal shall not expire solely by reason of the Consumer's use of EWC Play during the withdrawal period. The Consumer may exercise the right of withdrawal at any time during the fourteen (14) day withdrawal period regardless of whether the Consumer has begun using EWC Play. Upon valid withdrawal, the Organizer shall cease providing EWC Play to the Consumer and shall delete or anonymise the Consumer's personal data in accordance with Applicable Data Protection Laws, subject to any retention obligations under Applicable Law.
28.7. Model withdrawal form (complete and return this form only if you wish to withdraw from the contract): To: Esports Foundation, 3450 Al Imam Saud Ibn Faisal Rd, 6496 Al Malqa District, 13523, Riyadh, Kingdom of Saudi Arabia, ewcplay@esportsfoundation.com: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service: EWC Play, Ordered on (*)/received on (*), Name of consumer(s), Address of consumer(s), Signature of consumer(s) (only if this form is notified on paper), Date. (*) Delete as appropriate.
28.8. To the extent that EWC Play constitutes a digital content or digital service within the meaning of Directive (EU) 2019/770 as implemented in the Consumer's country of habitual residence, the Organizer shall ensure that EWC Play conforms to the objective and subjective conformity requirements set out in that Directive for the duration of the continuous supply. Where EWC Play does not conform to those requirements, the Consumer shall be entitled to the remedies provided under the implementing legislation of the Consumer's country of habitual residence, including the right to have the lack of conformity remedied, to receive a proportionate reduction in any consideration given (where applicable), or to terminate the contract.
